1.00 Condition

The Hirer acknowledges that the Vehicle has been inspected and the Vehicle as being in a good state of repair, not include manufacturer’s defects which would not have been visible upon inspection. The Owner has the right to inspect the Vehicle without prior notice, at all reasonable times during the term of the Agreement.

1.01 Vehicle Cost Disclosure

The full retail value of the Vehicle as of 19.08.2025 is £55,000.

2.00 Rental Amount

The Hirer hereby agrees to pay the Owner a rate of £500 per week [With Insurance]. The Hirer hereby agrees to pay a deposit and the first week rent in advance [Already Paid ].

2.01 Down Payment

The Hirer has provided a payment of £500 as rental deposit in accordance with the terms of this Hire agreement.

2.02 Security Deposit

In addition to the fees listed in the Hired Amount and Late Return, The Hirer agrees to pay a deposit (as mentioned above in 2.01) at the time this Agreement is signed. During the term of this Car Rental Agreement any outstanding charges, fines or damage to the Vehicle or equipment will be deducted from your deposit by the Owner. In the absence of damage or loss, said deposit shall be returned to the Renter’s bank account within 14 days of your contract end date..

The Hirer is liable for all tolls incurred during the hired period, any penalty offences committed under the Road Traffic Act 1991 (as amended), PoFA Act 2012 (as amended), London Local Authorities and Transport for London Act 2003 (as amended), including but not restricted to parking tickets, wheel clamping fines, compound charges, bus lane fines.

The Hirer accepts liability for motoring offences under the Traffic Regulation Act 1884 and the Road Traffic Offenders Act 1988 during the rental period. The Hirer is liable for charges by private parking companies (UKPC, TNC, etc.) under PoFA 2012.

The Hirer is responsible for Dartford crossing, ULEZ, and Central London Congestion Charges.

As the logbook is in our name, we will receive PCNs first and transfer them to the PCO driver's name.

Consent: You agree Brownhill Group Limited will pass your personal information to relevant bodies to transfer PCNs/Fines incurred during the rental period.

Refundable Security Deposit: A security deposit of £500 will be used in the event of loss or damage. If the repair/replacement exceeds this amount, the Hirer pays the balance.

INSURANCE CLAIM

The Hirer authorises Brownhill Group Limited to handle all insurance claims related to the hired vehicle on behalf of the Hirer. The Owner shall be the sole beneficiary of any insurance claim settlement. The Hirer shall cooperate fully and not contact the insurer directly. Breach may result in termination.

VEHICLE RENTAL AGREEMENT – TERMS & CONDITIONS
1.00 Condition of Vehicle

The Hirer acknowledges that the Vehicle has been inspected and confirmed to be in good repair at the start of the hire, excluding manufacturer’s defects not visible upon inspection. The Owner may inspect at any reasonable time without notice.

1.01 Vehicle Cost Disclosure

Vehicle retail value as of 19.08.2025: £55,000.

2.00 Rental Amount

Hirer agrees to pay £500/week inclusive of insurance, weekly in advance. First week + deposit paid before commencement.

2.01 Down Payment

Deposit of £500 provided.

2.02 Security Deposit

Refundable deposit of £500. May cover unpaid fines, penalties, damages, late fees. Refunded within 14 days post end date if no liabilities.

2.03 Hire Duration

Agreement begins on 04.11.2025 and continues until the agreement expire date. Minimum 3 months.

2.04 Hire Payment Due Date

Rental payments must be made weekly in advance by standing order. Late payment will incur a charge of £10 per day. If payment is more than 3 days late without prior agreement, the Agreement will be terminated and the deposit forfeited.

2.05 Late Payment & Fraud Protection

Payments must be made in advance by standing order to Brownhill Group Ltd’s bank account only. Cash payments, third-party transfers, or suspicious payment sources will not be accepted. A £10 daily late fee applies. If payment is delayed more than 3 days, the Agreement is terminated, the Vehicle repossessed, and the deposit forfeited. The Owner may share Hirer details with law enforcement in cases of fraud.

3.00 Event of Default

If the Hirer fails to make payment within one week, the Agreement shall terminate immediately and the Vehicle must be returned. The Owner reserves the right to recover outstanding payments through third-party recovery agents or legal action.

3.01 Excess Mileage Charges

Allowance: 4,000 Miles per month, 1000 miles per week pro rata. Excess charged at £0.50 per mile.

3.02 Late Return

£107.14 per day for each additional day.

3.03 Loss of Use

In addition to charges under clause 3.02, where the Vehicle is unavailable for hire due to late return, accident, damage, or breach of this Agreement, the Hirer shall be liable for the Owner’s reasonable loss of use at the daily rental equivalent until the Vehicle is returned or repaired and made available for hire.

4.00 Cancellation Policy
4.01 Cancellation – Fraud & Breach

The Owner reserves the right to terminate this Agreement immediately without refund if the Hirer is found to have provided false personal details, supplied fraudulent documents, or used the Vehicle for unauthorised or illegal purposes. In such cases, Brownhill Group Ltd will repossess the Vehicle without notice and retain all deposits and fees.

5.00 Inclusive Insurance

The Hirer acknowledges that the Vehicle is hired inclusive of insurance provided or approved by the Owner. The Hirer may not obtain alternative insurance without Owner’s consent. Misrepresentation will result in termination.

6.00 Accidents & Damage

In the event of an accident, the Hirer must secure the Vehicle, take photographs, and notify the Police if necessary. The Hirer must report to both the insurer and the Owner within 24 hours. All repair or replacement costs are the responsibility of the Hirer, including windscreen and tyre damage.

7.01 Accidents – Liability & Process

All accidents must be reported immediately. Failure to report may invalidate insurance; costs fall to Hirer. Full excess (£500) payable. False statements/withheld information → civil/criminal action.

7.02 Breakdown & Recovery

In the event of a breakdown the Hirer must contact the Owner immediately and follow instructions regarding approved recovery services. Unauthorised repairs, parts, or recovery services will not be reimbursed. The Owner will not be liable for consequential loss arising from breakdowns; the Hirer’s remedies are limited to repair or a reasonable substitute vehicle if available.

8.00 Owner’s Responsibilities

The Owner shall ensure the Vehicle remains roadworthy, serviced, and MOT compliant. The Owner will give at least 3 days’ notice for service appointments or inspections.

9.00 Hirer Responsibilities

The Hirer must return the Vehicle in the same condition as at commencement, with a full fuel tank and clean interior. The Hirer is responsible for tyre punctures, lost keys, incorrect fuel usage, and any other negligence. The Vehicle must not be sublet, modified, or operated by an unauthorized driver..

9.01 Maintaining Vehicle Standards

The Hirer must keep the Vehicle in clean, roadworthy, and presentable condition at all times. If returned in poor condition, professional cleaning or repair costs will be charged. Any tampering with mileage or security devices will result in termination.

9.02 Take Care of the Vehicle

Daily checks (tyres/oil/coolant/lights). Use correct fuel. No racing/towing/off-road use.

9.03 Refuelling & Cleanliness

The Vehicle must be returned with a full tank and a clean interior. Where the Vehicle is returned with less than a full tank, the Hirer will be charged for fuel plus a reasonable refuelling service charge. Excessive dirt, odours (including smoke/vape), or staining will incur a professional valeting charge.

9.04 Keys, Immobilisers & Security

The Hirer is responsible for safeguarding keys, key cards, fobs, and immobilisers. Lost or damaged items will be charged at replacement cost including programming and callout where applicable. The Hirer must keep the Vehicle locked and secured when unattended.

10.00 Penalties, Fines & Tolls

Hirer liable for PCNs, parking, ULEZ, Congestion, Dart, etc. Owner will transfer liability to Hirer.

10.01 Consent to Use & Disclosure of Personal Information

The Hirer consents to Brownhill Group Limited using and disclosing Hirer details (including full name, address, driving licence number, PHV number, and contact information) to competent authorities and private enforcement bodies solely for the purpose of transferring liability and/or resolving Penalty Charge Notices, tolls, ULEZ/Congestion charges, and other motoring offences incurred during the hire period.

11.00 Vehicle Care

Operate safely and per Owner’s instructions & law.

12.00 Inspections

Owner may inspect monthly without notice.

12.01 Recovery & Repossession

Where the Hirer is in material breach (including but not limited to non-payment, fraud, unauthorised use, or failure to return on demand), the Owner may recover or immobilise the Vehicle without notice and at the Hirer’s expense. The Hirer shall cooperate to facilitate safe collection.

13.00 Exclusions

No illegal use; no outside UK without written permission; no towing/competitions; only the Hirer may drive.

14.00 Legal Framework

English law. Prevailing party recovers legal/collection fees. Entire agreement; amendments in writing signed by both Parties. Hirer confirms business use (not consumer credit).

14.01 Data Protection

The Owner will process personal data as a controller for the performance of this Agreement, for compliance with legal obligations, and for legitimate interests (including fraud prevention, PCN transfers and asset protection). The Hirer’s rights are as set out under applicable UK data protection laws.

14.02 Notices

Notices may be delivered by email or to the last known postal address provided by the Hirer. Notices are deemed received on the day of sending (email) or two business days after posting (UK post).

14.03 Severability

If any provision is found invalid or unenforceable, the remainder shall continue in full force and effect.

14.04 Assignment

The Hirer may not assign or transfer rights or obligations under this Agreement without the Owner’s prior written consent. The Owner may assign its rights at any time.

14.05 Force Majeure

Neither party shall be liable for delay or failure to perform due to events beyond reasonable control (including but not limited to acts of God, strikes, war, or government restrictions). Payment obligations already accrued are not excused.

14.06 Electronic Signatures

The Parties agree that electronic signatures and electronic records are valid and enforceable for all purposes of this Agreement, and that a PDF or electronically stored copy is admissible as evidence to the same extent as an original.
